NUTZUNGSBEDINGUNGEN FÜR STICK- und PLOTTERDATEIEN,

APPLIKATIONSVORLAGEN und HANDSTICKVORLAGEN

(diese werden nochmals bei jedem Kauf im ZipOrdner mitgesendet!)

 

 

Freebies dürfen nur privat genutzt werden!

 

Die gekauften Stick- , Plotter-  sowie Applikationsmotive dürfen gewerblich auf selbst geschneiderter Kleidung, Kissen, Handtücher usw. in geringer Stückzahl von bis zu 50Stckverwendet werden.

D.h. ein Kleid (oder Kissen usw.) mit den Mustern darf nicht öfter als 50 mal genäht und verkauft werden.

 

Bei mehr als 50x pro Motiv bitte ich um kurze Rücksprache!!! Eine Massenproduktion ist untersagt!

 

Bei einer kommerziellen Nutzung der Dateien (Verkauf von handgefertigten Produkten), die Quellenangabe „Stickdatei by MariLena-Stoffzaubereien“ nicht vergessen!

 

Es ist NICHT gestattet, die DATEIEN (Muster) und/oder die fertigen Stickmuster (gestickte AUFNÄHER / APPLIKATIONEN / BUTTONS / PATCHES / BÜGELBILDER / AUFBÜGLER ) selbst zu verkaufen, zu tauschen, zu verschenken oder Kopien für Dritte zu machen. 
Ich weise zudem darauf hin, dass ausschließlich ich weiterhin Rechtinhaber (Urheber) an meinen Stickdateien bin. 
Vervielfältigungen und Veränderungen der Dateien sind nicht gestattet.

1) Geltungsbereich
1.1 Diese Allgemeinen Geschäftsbedingungen (nachfolgend "AGB") der Maria Hackstein (nachfolgend "Unternehmer"), gelten für alle Verträge zur Bereitstellung von Daten, die in digitaler Form erstellt und bereitgestellt werden (digitale Inhalte), die ein Verbraucher oder Unternehmer (nachfolgend "Kunde") mit dem Unternehmer hinsichtlich der vom Unternehmer in seinem Online-Shop beschriebenen digitalen Inhalte abschließt. Hiermit wird der Einbeziehung von eigenen Bedingungen des Kunden widersprochen, es sei denn, es ist etwas anderes vereinbart.
1.2 Verbraucher im Sinne dieser AGB ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
1.3 Unternehmer im Sinne dieser AGB ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.

2) Vertragsschluss
2.1 Die im Online-Shop des Unternehmers beschriebenen Inhalte stellen keine verbindlichen Angebote seitens des Unternehmers dar, sondern dienen zur Abgabe eines verbindlichen Angebots durch den Kunden.
2.2 Der Kunde kann das Angebot über das in den Online-Shop des Unternehmers integrierte Online-Bestellformular abgeben. Dabei gibt der Kunde, nachdem er die ausgewählten Inhalte in den virtuellen Warenkorb gelegt und den elektronischen Bestellprozess durchlaufen hat, durch Klicken des den Bestellvorgang abschließenden Buttons ein rechtlich verbindliches Vertragsangebot in Bezug auf die im Warenkorb enthaltenen Inhalte ab. Ferner kann der Kunde das Angebot auch per E-Mail gegenüber dem Unternehmer abgeben.
2.3 Der Unternehmer kann das Angebot des Kunden innerhalb von fünf Tagen annehmen,
- indem er dem Kunden eine schriftliche Auftragsbestätigung oder eine Auftragsbestätigung in Textform (Fax oder E-Mail) übermittelt, wobei insoweit der Zugang der Auftragsbestätigung beim Kunden maßgeblich ist, oder
- indem er dem Kunden die bestellten Inhalte bereitstellt, oder
- indem er den Kunden nach Abgabe von dessen Bestellung zur Zahlung auffordert.
Liegen mehrere der vorgenannten Alternativen vor, kommt der Vertrag in dem Zeitpunkt zustande, in dem eine der vorgenannten Alternativen zuerst eintritt. Die Frist zur Annahme des Angebots beginnt am Tag nach der Absendung des Angebots durch den Kunden und endet mit dem Ablauf des fünften Tages, welcher auf die Absendung des Angebots folgt. Nimmt der Unternehmer das Angebot des Kunden innerhalb vorgenannter Frist nicht an, so gilt dies als Ablehnung des Angebots mit der Folge, dass der Kunde nicht mehr an seine Willenserklärung gebunden ist.
2.4 Bei Auswahl einer von PayPal angebotenen Zahlungsart erfolgt die Zahlungsabwicklung über den Zahlungsdienstleister PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxemburg (im Folgenden: „PayPal“), unter Geltung der PayPal-Nutzungsbedingungen, einsehbar unter https://www.paypal.com/de/webapps/mpp/ua/useragreement-full oder - falls der Kunde nicht über ein PayPal-Konto verfügt – unter Geltung der Bedingungen für Zahlungen ohne PayPal-Konto, einsehbar unter https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. Zahlt der Kunde mittels einer im Online-Bestellvorgang auswählbaren von PayPal angebotenen Zahlungsart, erklärt der Verkäufer schon jetzt die Annahme des Angebots des Kunden in dem Zeitpunkt, in dem der Kunde den Button anklickt, welcher den Bestellvorgang abschließt.
2.5 Bei der Abgabe eines Angebots über das Online-Bestellformular des Unternehmers wird der Vertragstext nach dem Vertragsschluss vom Unternehmer gespeichert und dem Kunden nach Absendung von dessen Bestellung in Textform (z. B. E-Mail, Fax oder Brief) übermittelt. Eine darüber hinausgehende Zugänglichmachung des Vertragstextes durch den Unternehmer erfolgt nicht. Sofern der Kunde vor Absendung seiner Bestellung ein Nutzerkonto im Online-Shop des Unternehmers eingerichtet hat, werden die Bestelldaten auf der Website des Unternehmers archiviert und können vom Kunden über dessen passwortgeschütztes Nutzerkonto unter Angabe der entsprechenden Login-Daten kostenlos abgerufen werden.
2.6 Vor verbindlicher Abgabe der Bestellung über das Online-Bestellformular des Unternehmers kann der Kunde mögliche Eingabefehler durch aufmerksames Lesen der auf dem Bildschirm dargestellten Informationen erkennen. Ein wirksames technisches Mittel zur besseren Erkennung von Eingabefehlern kann dabei die Vergrößerungsfunktion des Browsers sein, mit deren Hilfe die Darstellung auf dem Bildschirm vergrößert wird. Seine Eingaben kann der Kunde im Rahmen des elektronischen Bestellprozesses so lange über die üblichen Tastatur- und Mausfunktionen korrigieren, bis er den Button anklickt, welcher den Bestellvorgang abschließt.
2.7 Für den Vertragsschluss steht ausschließlich die deutsche Sprache zur Verfügung.
2.8 Die Bestellabwicklung und Kontaktaufnahme finden in der Regel per E-Mail und automatisierter Bestellabwicklung statt. Der Kunde hat sicherzustellen, dass die von ihm zur Bestellabwicklung angegebene E-Mail-Adresse zutreffend ist, so dass unter dieser Adresse die vom Unternehmer versandten E-Mails empfangen werden können. Insbesondere hat der Kunde bei dem Einsatz von SPAM-Filtern sicherzustellen, dass alle vom Unternehmer oder von diesem mit der Bestellabwicklung beauftragten Dritten versandten E-Mails zugestellt werden können.

3) Widerrufsrecht
Verbrauchern steht grundsätzlich ein Widerrufsrecht zu. Nähere Informationen zum Widerrufsrecht ergeben sich aus der Widerrufsbelehrung des Unternehmers.

4) Preise und Zahlungsbedingungen
4.1 Die vom Unternehmer angegebenen Preise sind Gesamtpreise und enthalten die gesetzliche Umsatzsteuer.
4.2 Bei Zahlungen in Ländern außerhalb der Europäischen Union können im Einzelfall weitere Kosten anfallen, die der Unternehmer nicht zu vertreten hat und die vom Kunden zu tragen sind. Hierzu zählen beispielsweise Kosten für die Geldübermittlung durch Kreditinstitute (z.B. Überweisungsgebühren, Wechselkursgebühren).
4.3 Die Zahlungsmöglichkeiten werden im Online-Shop des Unternehmers angegeben.
4.4 Ist Vorauskasse per Banküberweisung vereinbart, ist die Zahlung sofort nach Vertragsabschluss fällig, sofern die Parteien keinen späteren Fälligkeitstermin vereinbart haben.
4.5 Bei Auswahl einer über den Zahlungsdienst „PayPal“ angebotenen Zahlungsart erfolgt die Zahlungsabwicklung über PayPal, wobei sich PayPal hierzu auch der Dienste dritter Zahlungsdienstleister bedienen kann. Sofern der Verkäufer über PayPal auch Zahlungsarten anbietet, bei denen er gegenüber dem Kunden in Vorleistung geht (z. B. Rechnungskauf oder Ratenzahlung), tritt er seine Zahlungsforderung insoweit an PayPal bzw. an den von PayPal beauftragten und dem Kunden konkret benannten Zahlungsdienstleister ab. Vor Annahme der Abtretungserklärung des Verkäufers führt PayPal bzw. der von PayPal beauftragte Zahlungsdienstleister unter Verwendung der übermittelten Kundendaten eine Bonitätsprüfung durch. Der Verkäufer behält sich vor, dem Kunden die ausgewählte Zahlungsart im Falle eines negativen Prüfungsergebnisses zu verweigern. Bei Zulassung der ausgewählten Zahlungsart hat der Kunde den Rechnungsbetrag innerhalb der vereinbarten Zahlungsfrist bzw. in den vereinbarten Zahlungsintervallen zu bezahlen. Er kann in diesem Fall nur an PayPal bzw. den von PayPal beauftragten Zahlungsdienstleister mit schuldbefreiender Wirkung leisten. Der Verkäufer bleibt jedoch auch im Falle der Forderungsabtretung zuständig für allgemeine Kundenanfragen z. B. zur Ware, Lieferzeit, Versendung, Retouren, Reklamationen, Widerrufserklärungen und -zusendungen oder Gutschriften.

5) Bereitstellung der Inhalte
Digitale Inhalte werden dem Kunden wie folgt bereitgestellt:

6) Einräumung von Nutzungsrechten
6.1 Sofern sich aus der Inhaltsbeschreibung im Online-Shop des Unternehmers nichts anderes ergibt, räumt der Unternehmer dem Kunden an den bereitgestellten Inhalten das nicht ausschließliche, örtlich und zeitlich unbeschränkte Recht ein, die Inhalte zu privaten sowie zu kommerziellen Zwecken zu nutzen.
6.2 Eine Weitergabe der Inhalte an Dritte oder die Erstellung von Kopien für Dritte außerhalb des Rahmens dieser AGB ist nicht gestattet, soweit nicht der Unternehmer einer Übertragung der vertragsgegenständlichen Lizenz an den Dritten zugestimmt hat.
6.3 Soweit sich der Vertrag auf die einmalige Bereitstellung eines digitalen Inhalts bezieht, wird die Rechtseinräumung erst wirksam, wenn der Kunde die vertraglich geschuldete Vergütung vollständig geleistet hat. Der Unternehmer kann eine Benutzung der vertragsgegenständlichen Inhalte auch schon vor diesem Zeitpunkt vorläufig erlauben. Ein Übergang der Rechte findet durch eine solche vorläufige Erlaubnis nicht statt.

7) Mängelhaftung
Es gilt die gesetzliche Mängelhaftung.

8) Besondere Bedingungen für die Bearbeitung von digitalen Inhalten nach bestimmten Vorgaben des Kunden
8.1 Schuldet der Unternehmer nach dem Inhalt des Vertrages neben der Bereitstellung von digitalen Inhalten auch deren Bearbeitung nach bestimmten Vorgaben des Kunden, hat der Kunde dem Unternehmer alle für die Bearbeitung erforderlichen Inhalte wie Texte, Bilder oder Grafiken in den vom Unternehmer vorgegebenen Dateiformaten, Formatierungen, Bild- und Dateigrößen zur Verfügung zu stellen und ihm die hierfür erforderlichen Nutzungsrechte einzuräumen. Für die Beschaffung und den Rechteerwerb an diesen Inhalten ist allein der Kunde verantwortlich. Der Kunde erklärt und übernimmt die Verantwortung dafür, dass er das Recht besitzt, die dem Unternehmer überlassenen Inhalte zu nutzen. Er trägt insbesondere dafür Sorge, dass hierdurch keine Rechte Dritter verletzt werden, insbesondere Urheber-, Marken- und Persönlichkeitsrechte.
8.2 Der Kunde stellt den Unternehmer von Ansprüchen Dritter frei, die diese im Zusammenhang mit einer Verletzung ihrer Rechte durch die vertragsgemäße Nutzung der Inhalte des Kunden durch den Unternehmer diesem gegenüber geltend machen können. Der Kunde übernimmt hierbei auch die notwendigen Kosten der Rechtsverteidigung einschließlich aller Gerichts- und Anwaltskosten in gesetzlicher Höhe. Dies gilt nicht, wenn die Rechtsverletzung vom Kunde nicht zu vertreten ist. Der Kunde ist verpflichtet, dem Unternehmer im Falle einer Inanspruchnahme durch Dritte unverzüglich, wahrheitsgemäß und vollständig alle Informationen zur Verfügung zu stellen, die für die Prüfung der Ansprüche und eine Verteidigung erforderlich sind.
8.3 Der Unternehmer behält sich vor, Bearbeitungsaufträge abzulehnen, wenn die vom Kunde hierfür überlassenen Inhalte gegen gesetzliche oder behördliche Verbote oder gegen die guten Sitten verstoßen. Dies gilt insbesondere bei Bereitstellung verfassungsfeindlicher, rassistischer, fremdenfeindlicher, diskriminierender, beleidigender, Jugend gefährdender und/oder Gewalt verherrlichender Inhalte.

9) Anwendbares Recht
Für sämtliche Rechtsbeziehungen der Parteien gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Gesetze über den internationalen Kauf beweglicher Waren. Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird.

10) Alternative Streitbeilegung
10.1 Die EU-Kommission stellt im Internet unter folgendem Link eine Plattform zur Online-Streitbeilegung bereit: https://ec.europa.eu/consumers/odr
Diese Plattform dient als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten aus Online-Kauf- oder Dienstleistungsverträgen, an denen ein Verbraucher beteiligt ist.
10.2 Der Unternehmer ist zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle nicht verpflichtet, hierzu aber bereit.

A. General Terms and Conditions

1) Scope of Application
1.1 These Terms and Conditions of the company Maria Hackstein (hereinafter referred to as "Seller”) shall apply to all contracts a consumer or a trader (hereinafter referred to as "Client") concludes with the Seller related to the seller's goods and/or services presented by the Seller on the electronic platform Etsy (hereinafter referred to as "Etsy”). The inclusion of the Client's own conditions is herewith objected to, unless other terms have been stipulated.
1.2 These Terms and Conditions regarding contracts for the supply of digital content apply accordingly, unless expressly otherwise agreed.
1.3 Regarding contracts for the delivery of vouchers, these general Terms and Conditions apply accordingly, unless explicitly regulated otherwise.se.
1.4 A consumer pursuant to these Terms and Conditions is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity. A trader pursuant to these Terms and Conditions is any natural or legal person or company with legal personality acting in the performance of a commercial or self-employed occupational activity when concluding a legal transaction.
1.5 Digital content pursuant to these Terms and Conditions means data, which are not contained on a tangible medium and which are produced in digital form and supplied by the Seller granting certain rights of use regulated specifically in these Terms and Conditions.

2) Conclusion of the Contract
2.1 When placing an item on the electronic platform Etsy , the Seller shall make a binding offer to the interested party for the sale of this item.
2.2 The Client can accept the Seller’s offer via the Etsy online order form. In doing so, the Client has to place the selected item in the virtual Etsy shopping basket and subsequently he has to go through the ordering steps specified by Etsy. By clicking on the button finalizing the order process, the Client declares the acceptance of the offer, whereby a contract comes into effect regarding the item previously selected by the Client.
2.3 The contract's content will be stored by the Seller and will be sent to the Client in writing including these Terms and Conditions and Client Information in text form (for example via e-mail, fax or letter) after conclusion of the contract. In addition, the contract's content will be stored by Etsy and can be called free of charge by the Client via his Etsy password-protected customer account.
2.4 The Client can correct all the data entered via the technical means provided by Etsy prior to submitting his order. Corrections can be made directly in the respective input fields of the online shop via the usual keyboard and mouse function.
2.5 The German language is exclusively available for the conclusion of the contract.

3) Right to Cancel
Consumers are entitled to the right to cancel. Further information on the right to cancel can be found in the Seller’s instructions regarding the right to cancel

4) Price and Delivery Costs
4.1 The prices indicated by the Seller are final prices and include the legal value added tax. Any additional delivery and shipping costs are indicated in each respective product description if applicable.
4.2 Various modes of payment are available for the Client which are indicated in the Etsy Seller's online shop.

4.4 If payment in advance is agreed, payment is due immediately after conclusion of the contract.

5) Shipment and delivery conditions
5.1 Should the assigned transport company return the goods to the Seller, because delivery to the Client was not possible, the Client bears the costs for the unsuccessful dispatch. This shall not apply if the delivery cannot be made due to circumstances beyond the Client's control or if he has been temporarily impeded to receive the offered service, unless the Seller has notified the Client for a reasonable time in advance about the service.
5.2 Should the Client collect the goods himself, the Seller informs the Client via e-mail, that the goods are ready for collection. 6) Granting the rights of use for digital content
6.1 Unless stated otherwise in the Seller’s Etsy description of contents, the Seller grants the Client the non-exclusive, temporarily and regionally unlimited right to use the supplied content for private and business purposes.
6.2 Passing on of content or the production of copies to third parties outside the framework of these Terms and Conditions is prohibited, unless the Seller has consented to the transfer of the license covered by the contract for third parties.
6.3 Pursuant to article 158, paragraph 1 German Civil Code, granting of rights will only be legally valid once the Client has paid in full the sum owed. The Seller my permit the use of digital content covered by the contract already prior to that date. Such a provisional permit does not lead to a transfer of rights.

7) Reservation of Proprietary Rights

C. Instructions for cancellation

Right to cancel
You have the right to cancel this contract within fourteen days without giving any reason.
In the case of contracts for the delivery of goods, the cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
If the contract is a contract for the supply of data which are not supplied on a tangible medium and produced and made available in digital form (digital content), the cancellation period ends at the end of 14 days after the day on which the contract is entered into.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and not later than fourteen days after the day on which we are informed about your decision to cancel this contract. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods

Exclusion and/or premature expiration of the right to cancel
The right to cancel does not apply for consumers who, at the time of concluding the contract, are not nationals of a member state of the European Union and whose exlusive residence and address of delivery are located outside of the European Union.
In case of contracts for the supply of digital goods, the right of cancellation shall expire prematurely if we have started the performance of the contract after you have expressly agreed that we start the performance of the contract before the expiry of the cancellation period, and you have confirmed to us your knowledge that you lose your right of cancellation by agreeing to start the performance of the contract, and if we have provided you with a confirmation of the contract on a durable medium containing the content of the contract including the aforementioned conditions relating to the premature expiry of the right of cancellation.
